Terms of Use For Digital Products

By purchasing digital products from 11th Street Design, you agree to abide by the following terms of use:

1. Permitted Use:

   • You are authorized to use our digital files to create commercial finished products. However, these products must be physical goods that are printed.
   • The digital graphics provided by 11th Street Design should not make up more than 30% of the final printed product.
   • Examples of acceptable finished products include but are not limited to: invitations, cards, planner stickers, party printables, art prints, stationery, bookmarks, coffee mug or t-shirt designs, tumbler wraps, birth announcements, logos, decals, business cards, blog designs, and more.

2. Print on Demand:

   • You are allowed to use our digital files for any print on demand products.

3. Personal Use:

   • Feel free to utilize our digital files for unlimited personal projects.

4. Prohibited Actions:

   • It is strictly forbidden to copy, share, or resell our digital files.
   • You are not permitted to combine our digital files to create derivative designs.
   • Selling our digital files as they are is strictly prohibited.
   • Examples of unacceptable use include utilizing our digital files for digital papers, backgrounds, clip art, or any digital image that is intended to be used as a design resource rather than a finished design.

We kindly request that you respect these terms of use to protect our intellectual property. If you have any questions or concerns, please contact us.

1.  Terms and Conditions of Sale

A.  Payment Terms.

Our shopping cart is set up to accept credit card and e-check payments via Paypal. Paypal is the largest online payment processor and allows you to pay with a credit/debit card, checking account, or funds in your Paypal account.  Please note that if payment is made with an e-check you will not receive your product(s) until the payment clears.

B. Shipping Terms.

Once your payment is processed, we will send you a link for digital download. You should expect the links within 24 hours of your purchase.  If you do not receive your links within 24 hours check your spam folder for an email from us. If it’s still not there, send us an email to info@11thStreetDesign.com and we’ll re-send them.

C. Return Policies; Exchanges.

Due to the digital nature of our products, all sales are final. We do not accept any returns or offer any refunds. You acknowledge that all products on the Website are non-refundable and not returnable, under any circumstances.

D. Replacement Policy.

Please back up the digital files that you have downloaded from the links we send to you for archival purposes. If you fail to do so, we cannot guarantee that the exact volumes will be available in the future, as our design library evolves. 

If you have purchased digital files from this Website, we will resend the links for download for free ONLY if you are able to verify your purchase. You will need to provide us with your receipt via email (PayPal receipt, credit card receipt, etc). Otherwise, you will need to provide us with the following information: month and year of purchase, email address used for payment, first and last name of buyer and the transaction ID #. We will not search through our transactions to locate your purchases. 

If you cannot provide your proof of purchase information listed above, we will not resend the links for download. 

2.  Privacy Policy 

Please refer to our privacy policy for information on how we collect and use personal information provided by you. Your use of any information or materials on this website signifies your acknowledgment of, and agreement to our privacy policy.  We are committed to ensuring that your information is secure.  In order to prevent unauthorized access or disclosure we have put in place industry standard physical, electronic and managerial procedures to safeguard and secure the information we collect online.

Unauthorized use of this Website may give rise to a claim by 11th Street Design against you for damages and/or be a criminal offense.  These Terms of Use are governed by the laws of the State of Massachusetts, USA, without regard to its conflicts of laws provisions; the state and federal courts of which have sole and exclusive jurisdiction to resolve any actions or claims arising out of or in connection with your use of the Website and the products and services on the Website, and your breach of these Terms of Use.  You agree to submit to the jurisdiction of such courts. 

6.  Indemnity 

You agree to indemnify and hold 11th Street Design, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Website, and the Digital Downloads, products and services on this Website that is in violation of these Terms of Use and/or from any breach by you of these Terms of Use.

These Terms of Use are accepted upon your use of the Website, and the Digital Downloads, products and services on this Website.  The Terms of Use and Privacy Policy constitute the entire agreement of the parties with respect to your use of the Website, and the Templates, products and services on this Website.  If any provision of the Terms of Use is held unenforceable, the remaining provisions will be enforced to the maximum extent possible.  No waiver by 11th Street Design of any term in these Terms of Use constitutes a waiver of any other right, or right to enforce any subsequent breach of the Terms of Use.  In the event tth Street Design is forced to enforce its rights against you, in addition to any other remedies, you agree to pay 11th Street Design’s reasonable costs, including attorneys’ fees and costs of suit.
